CONSTRUCTION

CONSTRUCTION NOISE , Police Department
- Construction trades. The term "construction trades" shall mean any type of home repair, including but not limited to construction, repair, and/or maintenance of a new or existing structure and its appurtenances. This shall also cover landscaping construction, but not landscaping maintenance. The noise level exemption for construction trades shall only apply between the hours of 6:00 a.m. and 8:00 p.m. Monday through Friday and 8:00 a.m. and 8:00 p.m. Saturday and 9:00 a.m. and 8:00 p.m. Sunday.

- The protocol for opening cooling center is an extended period of time with temperatures in the upper 90s, or a large area affected by a sustained power outage expected to last for several hours while the temperatures are very high.
CREDIT CARDS
- Why doesn't the Village of Montgomery accept credit cards for payments?
The Village of Montgomery does not accept credit cards because the demand for acceptance of credit cards does not justify the expenses that would be incurred to implement such a system. The Village will continue to reevaluate this item as demand increases.

CURFEW , Police Department
- (a) It is unlawful for any person under the age of eighteen (18) to be present at or upon any public assembly, building, place, street or highway during the hours of applicability of this section, as described in subsection (c) of this section, unless such person satisfies one of the exceptions to this section described in subsection (b).
- (b) No person shall be convicted of a violation of this section if such person:
(1) Is accompanied and supervised by a parent or legal guardian; or
(2) Is accompanied and supervised by some other responsible companion at least 21 years of age, with their parent or legal guardian's knowledge and consent; or
(3) Is presently engaged in interstate or international travel; or,
(4) Is engaged on a necessary errand specifically authorized in writing by the minor's parent or legal guardian that features the following information:
a. The specific date and time of the errand;
b. The point of origination and destination for the errand; and,
c. The purpose of the errand; or,
(5) Is participating in, heading directly to, or returning directly from, without detour or stop:
a. Lawful employment; or,
b. School sanctioned activity; or,
c. A religious event; or,
d. An emergency involving the protection of a person or property from an imminent and unforeseen threat of serious bodily injury or substantial damage; or,
e. An activity involving the exercise of the minor's rights protected under the First Amendment to the United States Constitution or protected under Article I Sections 4 or 5 of the Illinois State Constitution; and the minor's home or residence; or,
(6) Is on the sidewalk abutting the minor's residence; or,
(7) Is married, has been married, or is an emancipated minor under the Emancipation of Minors Act.
- (c) The hours of applicability of this section are as follows:
(1) For persons who are under the age of 18, the hours of applicability shall be:
(2) Between 12:01 a.m. and 6:00 a.m. Saturday and Sunday.
(3) Between 11:00 p.m. on Sunday through Thursday, inclusive, and 6:00 a.m. on the following day.
- (d) Law enforcement officers involved in the enforcement of this section shall issue citation or make arrest, as appropriate, only after inquiry into the alleged violator's reason for being in a public place during curfew hours, and after such inquiry, then only if the officer reasonably believes that the person has violated this section and that such person's activities do not fall within the class of exceptions to this section described in subsection (b).

2. Provide a copy of your plat of survey showing the proposed location, distance to property lines and size of deck.

- These drawings should include the following:
- Size and depth of concrete foundation and location (minimum 42" below grade).
- Size, length, and spacing of all floor joists and type of flooring material.
- Size, length and spacing of any beams and support of same. Also, give type and grade of lumber.
- Show how deck and framing members are to be supported at house.
- Provide guardrail 36" high on any deck 24" or over above finished grade.
- Provide stairs and data on any deck over 8" above finished grade.
- Provide handrail on any set of stairs 24" or more above finished grade.
- Do not block any natural drainage of lot by construction of deck.
- Set backs vary, check with building inspector.

DOGS
- Sec. 4-3. Disposition of animals declared to be public nuisances.
(a) If, after investigation, an authorized village agent determines that the continued keeping of any animal constitutes a public nuisance, he or the aggrieved person shall immediately commence proceedings in the circuit court seeking abatement of the nuisance. The court shall order the destruction of the animal unless it finds that the owner of the animal has demonstrated, with a reasonable degree of certainty, that adequate measures have been or will be taken which will prevent any future occurrences resulting in the animal constituting a public nuisance.
(b) The court may also, upon application, order the impoundment of the animal, pending a final determination as to the disposition of the animal, if the court finds that:
(1) There is probable cause that the animal constitutes a public nuisance.
(2) Failure to impound the animal pending final determination as to disposition of the animal will result in a continued public nuisance of such severity and/or duration as to constitute an unreasonable burden or danger to the public welfare.
(c) All costs of impoundment shall be borne by the owner of the animal unless the court finds that the animal was not a public nuisance at the time of impoundment, in which case the cost of impoundment shall be borne by the village. (Ord. No. 983, § 1, 2-11-02)
- Sec. 4-4. Limit on number.
There shall be a maximum limitation per household of four (4) domestic animals, not to exceed two (2) dogs or two (2) cats, or two (2) of any one (1) species, except that any animal used as a bona fide service animal shall not be counted in determining the numbers of animals in a household. This means a household may have no more than 2 dogs and no more than 2 cats. Further, any newborn animals shall be allowed to remain in the household despite the limitations for up to six (6) months from the date of birth. (Ord. No. 1331, § 4-4 of Chapter 4 of the Village Code)
- Sec. 4-5. Registration of dogs or cats.
There shall be no village dog or cat license required. However, every person who owns, keeps or harbors a dog or cat within the limits of the village shall, within ten days of acquisition of the dog or cat, register the dog or cat or cause it to be registered for a license with the county clerk of the county in which the owner resides. (Ord. No. 983, § 1, 2-11-02)
- Sec. 4-7. Dogs and cats to be inoculated, licensed by county; reports of violations.
(a) No dog or cat shall be permitted to be or remain in the village unless properly inoculated for rabies as provided by section 8 of the Illinois Animal Control Act, and unless licensed by the county as provided by section 3 of the Illinois Animal Control Act.
(b) Any person finding a lost or stray dog or cat without a current rabies inoculation tag and current county license tag is encouraged to report such an animal to the police department. (Ord. No. 983, § 1, 2-11-02)
- Sec. 4-8. Animals at large.
No person who owns, keeps or harbors a domestic animal shall cause or permit such animal to run within the village. It shall be unlawful for any person to permit any chicken, duck, goose or turkey to run at large on any property not properly zoned. (Ord. No. 983, § 1, 2-11-02)
- Sec. 4-9. Dangerous animals.
(a) No person shall own, keep or harbor a dangerous animal within the city unless the person shall keep such animal safely and securely confined so as to protect from injury any person who shall lawfully come upon the premises or be in the vicinity where such animal may be located. Adequate warning by signs or otherwise shall be given to persons coming lawfully upon the premises or being in the vicinity of such dangerous animals.
(b) Any dangerous animal that attacks or injures any person or other animal within one year after a previous attack or injury is a public nuisance which may be abated in accordance with this chapter.
(c) Any animal that without provocation attacks or injures any person who is peaceably conducting himself in any place where he may lawfully be is a public nuisance which may be abated in accordance with this chapter. (Ord. No. 983, § 1, 2-11-02)
- Sec. 4-10. Animals disturbing the peace.
It shall be unlawful for the owner or person in charge or control of any animal, or for any person who has the authority or power to prevent the same, to suffer or permit any such animal to bark, howl, cry or make other distressing or loud or unusual noise or to disturb the peace or quiet of any place or neighborhood, family or person in the village. The disturbing of the peace or quiet of any such place or neighborhood or family or person in the city by any such animal is a public nuisance, and it shall be unlawful for any person to suffer or permit any such nuisance to exist. This provision shall not apply to properly zoned and constructed kennels, animal hospitals and pounds. (Ord. No. 983, § 1, 2-11-02)
- Sec. 4-11. Killing animals.
It shall be unlawful for any unauthorized person to kill or wound or attempt to kill or wound any domestic animal within the village limits. It shall be unlawful for any unauthorized person to kill or wound or attempt to kill or wound any wild animal within the village limits, except where properly licensed by the Illinois Department of Natural Resources to do so. (Ord. No. 983, § 1, 2-11-02)
- Sec. 4-12. Fighting animals or fowl.
It is prohibited for any person to (1) keep or use, (or to be in any way connected with the management of any room, place, building, enclosure or other premises, kept or used) for the purpose of fighting or baiting, any dog, cock or other animal, or (2) to permit such place to be kept or used for such purpose on premises owned, rented or controlled by him or her, or (3) to be present therein during such fighting or baiting. (Ord. No. 983, § 1, 2-11-02)
- Sec. 4-13. Injury to animals.
Any person who, as the operator of a vehicle, strikes any animal shall report such striking to the owner, if known, or the police department. No person shall however be under any obligation to (1) stop to render aid or assistance or (2) to apprehend or locate such animal. Notification to the police department, or to the owner, if known, may be made within a reasonable period of time after injury from a convenient and safe location to the operator of a vehicle. (Ord. No. 983, § 1, 2-11-02)
- Sec. 4-14. Raising, boarding to comply with zoning.
No one shall raise animals or fowl for sale within the village limits unless properly zoned, nor keep for profit any kennel for the boarding of animals unless properly zoned. (Ord. No. 983, § 1, 2-11-02)
DRIVERS LICENSE
DRIVEWAYS, Building Department
- Driveways that cross a public sidewalk shall conform to the sidewalk grade. The maximum grade of any driveway shall be less than 10%.
- Driveway cannot be more than 24 feet wide between street and property line.
- Driveway cannot be more than 30 feet wide between property line and house.
- No driveway or driveway approach shall be closer than one (1) foot from any side property line.
- That part of a sidewalk, which also is part of a driveway, shall be constructed to comply with 5.b. below. The thickness of the concrete shall not be less than five (5) inches.
- Bituminous approach and driveway:
- Excavate to 8".
- Stone base to be 6" compacted rock or stone.
- Stone base to be rolled with minimum 2-tone roller.
- Apply hot mix surface course or 2’ compacted 1-11 or
equivalent.
- Roll with 1 ½ - to 2-ton roller.
- Concrete approach
- Stone base to be 6" compacted crushed rock or limestone on tamped soil base.
- Slab shall be 5" thickness of 3,000 lb. P.S.I. concrete (maximum 5" slump).
- Concrete surface shall be troweled and brushed.
- Minimum 6-bag mix concrete with 6% air entrainment.
- Linseed oil seal coat as per manufacturer’s specs.
6. Driveways shall be extended to the front or rear corner of the house or to the garage apron is one is constructed, and must be extended to the rear on all lots where there is no attached garage. Such driveways shall be constructed with an impervious surface.
c. Concrete Driveway:
- Stone or sand base of 5" minimum thickness.
- Wire mesh reinforcing (6" x 6" 10/10 WWF) or 3/8" steel reinforcing rods 24" O/C both directions. (optional)
- Driveway slab shall be a minimum of 5" thickness of 3,000 lb P.S.I. concrete (maximum 5" slump.
- Concrete surface shall be trowled and brushed.
- Minimum 6-bag mix concrete with 6% air entrainment.
- Linseed oil seal coat as per manufacturer’s specs.
- A building permit is required for the construction of a driveway approach. The approach shall terminate at the curb line and no material or construction of any kind shall be placed on a street pavement or gutter. Alteration of street curbs is permitted upon issuance of a building permit for an approach.
- A pre-pour inspection is required. A final inspection is required when the work is done.
- Submit a plat of survey showing location of proposed driveway and/or approach, dimensions of driveway, and distance to property lines.
- An occupancy permit shall not be issued until the approach and driveway are completed.

LATEX PAINT
- Latex paint is no longer accepted at recycling centers.
- One gallon containers of solidified latex paint may be placed in with your regular trash. To solidify paint, leave the lid off until it dries and hardens, or add kitty litter or oil spill product to the paint.
- Larger five-gallon containers of paint must also be solidified before being disposed of. If the container is fairly full of paint, it may need to be picked up separately because it would make the trash can overweight. In such a case, place the container of paint next to the trash can and place a sticker on it. The weight limit on trash cans is 50 pounds.
LAWN WATERING, Public Works
- Permitted hours of water use is a time period of 6:00 a.m. to 9:00 a.m. and a time period of 6:00 p.m. to 9:00 p.m., May 1 through September 30, except that section (i)(1), Emergency proclamation, shall be in effect at all times.
- The use of water from the village water distribution system may only be used for landscape watering or the filling of swimming pools as follows:
a. All properties with even-numbered street numbers (i.e., numbers ending in 0, 2, 4, 6, or 8) may use village distributed water for landscape watering or pool filling on even-numbered calendar dates between the hours of 6:00 a.m. to 9:00 a.m. and 6:00 p.m. to 9:00 p.m., prevailing time;
b. All properties with odd-numbered street numbers (i.e., numbers ending in 1, 3, 5, 7, or 9) may use village distributed water for landscape watering or pool filling on odd-numbered calendar dates between the hours of 6:00 a.m. to 9:00 a.m. and 6:00 p.m. to 9:00 p.m., prevailing time.
c. There shall be no restrictions as to hours or days when water from the village water distribution system may be used for:
1. Landscape watering or sprinkling where such watering or sprinkling is done by a person using a hand-held watering device;
2. Filling swimming pools with a volume of 50 gallons or less;
3. The automatic watering of trees and shrubs by means of automatic root-feed or drip-irrigation systems within the drip line of the tree or shrub; or
4. Vehicle and equipment washing.
- Restrictions for sod laying and lawn seeding for new lawns. Notwithstanding the provisions of subsection (c) above, the following special regulations shall apply:
- Use of water from the village water distribution system for sod laying or lawn seeding for the establishment of new sod and seeded turf lawns is prohibited annually from July 1 through August 31. This prohibition shall not apply to soil erosion and sedimentation plans required pursuant to village ordinances (with approved plans) or for restorations due to required repairs of public utilities (e.g. water main breaks). Any required sedimentation plans or utility repair restorations shall follow the schedule delineated in subsection (2)a through c below.
- From May 1 through June 30, and from September 1 through September 30, water from the village water distribution system may be used for the establishment of sod and seeded turf lawns by sod placement or seeding, as follows:
- On the day new sod or seed has been placed, property owners may use automatic sprinkling devices to apply water from the village distribution system for a total period of time not to exceed eight hours;
- For the next nine days after the sod or seed has been placed, the property owner may water the sod or seed each day between the hours of 6:00 and 9:00 a.m., and 6:00 and 9:00 p.m., prevailing time;
- Following the first ten days after the sod or seed is placed, the provisions of subsection (c), above, shall apply.
(3) Prior to the execution of any real estate contract for the sale of newly constructed property, the builder or owner of such new construction shall:
a. Inform prospective purchasers of the restrictions upon the installation of new lawns and landscape set forth in this section;
b. Attach a copy of this section to such contract; and
c. Have the prospective purchasers sign a statement that he or she has been informed of the new lawn and landscape installation restrictions set forth in this section and have received a copy of this section.
(4) Upon application for a certificate of occupancy for new construction, the owner must submit the signed statement that the purchasers have been informed of the new lawn and landscape installation restrictions set forth in this section and have received a copy of this section.
(5) Where a certificate of occupancy is applied for prior to a sale of the unit, and the future occupant is unknown, the applicant for such certificate shall sign a statement that he or she shall comply with the requirements of this section at the time the real estate contract is executed.
- Waste of water prohibited. No person shall allow a continuous stream of water from the village water supply to run off into any gutter, ditch, drain, or street inlet while using water for any purpose.
- Commercial exceptions; organizations. The provisions of this section do not apply to commercial and industrial entities such that use of water necessary to maintain stock and continue normal business operations shall not be restricted. These exceptions do not apply to non-essential business uses such as decorative landscape watering or pool filling for non-display or non-sale uses.
- Bulk water rates. Bulk water rates shall be increased to three times the nonresident water rate during the term of this section.
- Hydrant use prohibited. Hydrants connected to the village water system for the purpose of extinguishing fires shall not be opened by any person, other than authorized village personnel, except for the purpose of extinguishing fires.
- Whenever the water supply of the village is diminished, from any cause such as but not limited to prolonged dry periods, increased water demands, equipment failure, water quality concerns, or diminished water supply, to an amount which in the opinion of the village manager is or is likely to become dangerous to the health and safety of the public, the village manager is hereby authorized and empowered to issue a proclamation in the form of a public notice containing regulations on the use of water from the village water distribution system. Such regulations may provide for the limited usage of water, limitations on days and hours of use for some or all purposes, and the prohibition of specified uses. Upon issuing said proclamation, the village manager shall make the contents thereof known to the public by news release to the local newspapers and radio media, and may also notify the citizens in any other practical manner that he or she shall devise. Further, the village manager shall immediately notify the village president and all members of the village board of trustees of the nature of the emergency and the regulations that have been imposed.
- The emergency proclamation of the village manager and the regulations imposed thereby, shall remain in full force and effect until any one of the following shall occur:
- The village manager determines that the emergency no longer exists and that the emergency proclamation, and the regulations imposed thereby, shall no longer continue in effect.
- The village board of trustees modifies, repeals or makes permanent the emergency proclamation, and the regulations imposed thereby, by means of an ordinance passed at any regular or special meeting of the village board of trustees.
- The first regular meeting of the village board of trustees occurring more than 30 days after the emergency proclamation of the village manager.
3. Any village employee or officer may, at the direction of the village manager, notify and warn any person of the effect of said proclamation and direct said person to comply with said watering or sprinkling restrictions.
4. If any person, after the village has taken the notification steps required in section 20-44(i)(1) above shall violate said restrictions of the proclamation, they shall be deemed to be in violation of this section.
- Penalty. Any person who or which violates, disobeys, neglects, fails to comply with or resists enforcement of the provisions of this section other than subsection (d)(1) hereof, shall be punished by a fine as follows:
- For each first offense . . . $50.00
- For each second offense . . . 100.00
- For each subsequent offense . . . 500.00
Each day a violation occurs or is permitted to continue will be considered a separate violation.
In the event any person has received a compliance ticket issued pursuant to the provisions of chapter 1, section 1-10 of the Village Code for a violation of this section, and has not paid the same, then the amount thereof shall be added to such person's water bill pursuant to the provisions of chapter 20, sections 20-50 and 20-52 of the Village Code.

What You Can Do To Control Mosquitoes:
Mosquitoes are an all too familiar summer nuisance. Not only are they annoying, they can also transmit encephalitis, malaria, and yellow fever to humans, and heartworm to pets. Apply mosquito repellent during periods of outdoor exposure, especially at dusk.
You can take simple, positive steps to reduce this menace right at home.
- Remove all standing water. Adult flying mosquitoes often rest in tall grass and shrubbery, but they cannot develop there. All mosquitoes need water to complete their life cycle. Some mosquitoes lay their eggs in standing water where they hatch in just a day or two. Other mosquitoes may lay their eggs in old tires, tin cans, or other water-holding containers.
- Get rid of old tires, tin cans, buckets, drums, bottles, or any water-holding containers.
- Fill in or drain any low places (puddles, ruts) in your yard.
- Keep drains, ditches and culverts clean of weeds and trash so water will drain properly.
- Cover trash containers to keep out rain water.
- Repair leaky pipes and outdoor faucets.
- Empty plastic wading pools at least weekly and store them indoors when not in use.
- Make sure your backyard pool is properly cared for all year, and especially while you are on vacation.
- Fill in tree rot holes and hollow stumps that hold water with sand or concrete.
- Change the water in birdbaths and plant pots or drip trays at least once a week.
- Keep grass cut short and shrubbery well trimmed around the house so adult mosquitoes will not hide there.

Is there a ban on parking on the streets during a snowstorm?
Yes! The Village Code states that
“It shall be unlawful for any person to park a motor vehicle or, if parked, to allow a motor vehicle to remain parked or standing in any public street or alley during or after a snowfall in which there is an accumulation of two inches of snow or more. This prohibition shall remain in effect until such time as the street or alley has been plowed or the snow has been removed therefrom. A village street shall not be deemed to have been plowed until the lane of traffic nearest the curb has been plowed or the snow has been removed therefrom.
“Whenever a police officer of the village finds a vehicle parked in violation of this section and where such vehicle constitutes an obstruction to traffic, interferes with the use of streets or in any other manner creates a dangerous or unsafe condition, such vehicle is declared a nuisance and a hazard to public safety; and the police officer may cause the removal of such vehicle to a public garage or other place of safety during snow removal operations of the village on such streets; and the expense of such removal and storage in such public garage shall be paid by the owner or operator of the vehicle in addition to any other penalties imposed by this chapter.”

PETS
- There shall be a maximum limitation per household of two (2) dogs or cats of any one (1) species, or a total not to exceed four (4), (this means a household may have no more than 2 dogs and no more than 2 cats) except that any animal used as a bona fide seeing eye dog shall not be counted in determining the numbers of animals in a household. Further, any newborn animals shall be allowed to remain in the household despite the limitations for up to six (6) months from the date of birth.
- Disposition of animals declared to be public nuisances.
(a)If, after investigation, an authorized village agent determines that the continued keeping of any animal constitutes a public nuisance, he or the aggrieved person shall immediately commence proceedings in the circuit court seeking abatement of the nuisance. The court shall order the destruction of the animal unless it finds that the owner of the animal has demonstrated, with a reasonable degree of certainty, that adequate measures have been or will be taken which will prevent any future occurrences resulting in the animal constituting a public nuisance.
(b)The court may also, upon application, order the impoundment of the animal, pending a final determination as to the disposition of the animal, if the court finds that:
(1)There is probable cause that the animal constitutes a public nuisance.
(2)Failure to impound the animal pending final determination as to disposition of the animal will result in a continued public nuisance of such severity and/or duration as to constitute an unreasonable burden or danger to the public welfare.
(c)All costs of impoundment shall be borne by the owner of the animal unless the court finds that the animal was not a public nuisance at the time of impoundment, in which case the cost of impoundment shall be borne by the village.
(a)No person shall own, keep or harbor within the village:
(1)All snakes, reptiles or lizards that are poisonous in nature.
(2)Any rodent weighing more than one pound, with the exception of guinea pigs.
(b)Any, snake, reptile, lizard, rodent or other creature covered by subsection (a) is declared a public nuisance, and may be abated in accordance with this chapter.
(c)This section shall not apply to properly zoned and constructed zoos, animal shelters, animal hospitals, kennels, pounds, pet stores and the scientific or research laboratories of education or other recognized institutions
- Dogs and cats to be inoculated, licensed by county; reports of violations.
(a)No dog or cat shall be permitted to be or remain in the village unless properly inoculated for rabies as provided by section 8 of the Illinois Animal Control Act, and unless licensed by the county as provided by section 3 of the Illinois Animal Control Act.
(b)Any person finding a lost or stray dog or cat without a current rabies inoculation tag and current county license tag is encouraged to report such an animal to the police department.
No person who owns, keeps or harbors a domestic animal shall cause or permit such animal to run within the village. It shall be unlawful for any person to permit any chicken, duck, goose or turkey to run at large on any property not properly zoned.
(a)No person shall own, keep or harbor a dangerous animal within the city unless the person shall keep such animal safely and securely confined so as to protect from injury any person who shall lawfully come upon the premises or be in the vicinity where such animal may be located. Adequate warning by signs or otherwise shall be given to persons coming lawfully upon the premises or being in the vicinity of such dangerous animals.
(b)Any dangerous animal that attacks or injures any person or other animal within one year after a previous attack or injury is a public nuisance which may be abated in accordance with this chapter.
(c)Any animal that without provocation attacks or injures any person who is peaceably conducting himself in any place where he may lawfully be is a public nuisance which may be abated in accordance with this chapter.
- Animals disturbing the peace.
It shall be unlawful for the owner or person in charge or control of any animal, or for any person who has the authority or power to prevent the same, to suffer or permit any such animal to bark, howl, cry or make other distressing or loud or unusual noise or to disturb the peace or quiet of any place or neighborhood, family or person in the village. The disturbing of the peace or quiet of any such place or neighborhood or family or person in the city by any such animal is a public nuisance, and it shall beunlawful for any person to suffer or permit any such nuisance to exist. This provision shall not apply to properly zoned and constructed kennels, animal hospitals and pounds.
It shall be unlawful for any unauthorized person to kill or wound or attempt to kill or wound any domestic animal within the village limits. It shall be unlawful for any unauthorized person to kill or wound or attempt to kill or wound any wild animal within the village limits, except where properly licensed by the Illinois Department of Natural Resources to do so.
- Fighting animals or fowl.
It is prohibited for any person to (1) keep or use, (or to be in any way connected with the management of any room, place, building, enclosure or other premises, kept or used) for the purpose of fighting or baiting, any dog, cock or other animal, or (2) to permit such place to be kept or used for such purpose on premises owned, rented or controlled by him or her, or (3) to be present therein during such fighting or baiting.
Any person who, as the operator of a vehicle, strikes any animal shall report such striking to the owner, if known, or the police department. No person shall however be under any obligation to (1) stop to render aid or assistance or (2) to apprehend or locate such animal. Notification to the police department, or to the owner, if known, may be made within a reasonable period of time after injury from a convenient and safe location to the operator of a vehicle.
- Raising, boarding to comply with zoning.
No one shall raise animals or fowl for sale within the village limits unless properly zoned, nor keep for profit any kennel for the boarding of animals unless properly zoned.
- Farm animals prohibited, exception for agricultural zones.
Farm animals, which shall include, but not be limited to, horses, cattle, swine (except pot bellied pigs) and fowl, shall not be harbored in the village, except on property zoned agricultural.
The owner of every animal shall be responsible for immediate removal and sanitary disposition of any excretion deposited by his animal anywhere in the village.
(a)No person or owner may abandon, cruelly beat, torment, overload, overwork, or otherwise abuse animals in a manner to cause unnecessary suffering.
(b)No person shall expose any known poisonous substance, whether mixed with food or not, so that the same shall be liable to be eaten by any animal; provided that it shall not be unlawful for a person to expose on his own property, commonly available wild animal abatement measures including rat poison or gopher, mice and insect control measures.
(c)No person shall fail to provide humane treatment to all animals which he or she owns, keeps or harbors. Humane treatment shall include but not be limited to, the following minimum standards:
(1)Water shall be available at all times to any confined or tied animal, bird or domestic pet.
(2)Shelter from freezing weather, snow and rain must be provided. Tied animals must have access to a shaded area at all times.
(3)No animal can be left in an automobile or similar enclosure without proper ventilation.
(4)Living quarters and enclosures will be kept in a humane condition.
- Impounding and enforcement authorized.
Any authorized agent shall have the power and authority to take up and impound any unlicensed dog, any animal found running at large in the village contrary to the provisions of this chapter or any dangerous or vicious animal that is not safely and securely confined in accordance with the provisions of this chapter.
- Destruction of dangerous animals.
If any dangerous, fierce or vicious animal cannot safely be taken up and impounded, such animal may be destroyed by any police officer. The disposition of the destroyed animal shall be in accordance with the provisions of state law.

RADON SYSTEMS
- Notwithstanding any provision of the village codes, all newly constructed residential units constructed in the village with basements after the date (April 23, 2001) of the ordinance from which this section is derived shall be constructed utilizing a passive subslab radon ventilation system with a four-inch vent pipe. The vent pipe shall be labeled so as to be readily identifiable as a part of the radon system. All residential units requiring a passive sub slab radon ventilation system shall also include a four-inch slush coat in all crawl spaces of all homes and a six-millimeter thickness visqueen (waterproof plastic) sheet.
RECREATION/UTILITY TRAILER
- All trailers are allowed to be parked in the driveway for a maximum of 72 hours for the purpose of loading and unloading. Anything over 72 hours would be considered storage, and the trailer must then be relocated to a side or rear yard area and must be parked on an improved surface.
ROOFING
- A building permit is needed when a new roof is put on or repaired. If hiring a roofer, make sure they are state licensed.
- Re-roofs may be applied up to and including the second layer.
- If two layers exist at time of permit, all other layers must be removed to original sheeting.

- A plat of survey with the shed location indicated on it must accompany the application.

- The minimum required side yard and rear yard setback from the lot line is three (3) feet.

- All sheds must be anchored to the ground.

SMOKE DETECTORS
- Landlords are responsible for providing tenants with smoke detectors, but tenants are responsible for keeping the detector working.
- All new homes must have a smoke detector on each floor and in each bedroom.
SNOW REMOVAL
- During and after a snowstorm, Village crews conduct a coordinated effort to clear away snow and provide safe, accessible streets throughout the Village.
- During a snowstorm, crews concentrate on clearing the primary thoroughfares, highly traveled intersections, and "trouble spots" first. These would be roads such as Montgomery Road, Douglas Road, the Mill / River / Webster connection through downtown, and Aucutt Road. While the initial effort on main streets has begun, additional crews begin to plow the roads that lead in and out of the neighborhoods. After clearing those streets, side streets, cul-de-sacs, and secondary roads are targeted. Plows will make at least one pass through all cul-de-sacs and side streets during storms, and will return to complete plowing once the snowstorm passes.
- Snow removal services to Illinois State Highways, including Routes 30, 25 and 31, are provided by the State. Please call the Illinois Department of Transportation at (847) 705-4162 or (847) 705-4163 if a snowy or icy condition is observed.
- According to agreements between the Village and developers, the Village will provide snow removal services to a new subdivision when a certain development stage requirement is met. Please call our Public Works Department at (630) 896-9241 if you need to verify if a street in a subdivision will be plowed by the Village.
- As crews clear the streets, snow and ice from the road are inevitably pushed back into driveways and other property entrances. Unfortunately, this is a nearly unavoidable aspect of snow removal operations. We realize this can be an inconvenience to residents and business owners, especially after considerable time and effort have been spent in clearing driveways. Village crews will work to minimize snow and ice deposits in excess of those normally encountered during snow plowing; however, they cannot return to spot plow individual driveways which have had snow plowed into them during normal plowing operations.
- If you believe your mailbox was damaged by Village snow removal operations, contact Public Works at 630-896-9241, Monday-Friday, 7 a.m. to 3 p.m. If you are putting up a new mailbox or replacing your existing one, please note that Village standards require the face of the mailbox to be between zero and six inches behind the back of the curb. For further details or a copy of the standard, please stop by the Building Department at the Village Hall.
- Clearing snow from sidewalks in front of your home is a gesture welcomed by all your neighbors. Doing so will allow them to use the sidewalks instead of the streets and make it safer for children walking to and from school. For those with fire hydrants in front of their homes, clearing snow away from the hydrant can greatly assist emergency operations.
Snow-storm parking regulations help the Public Works staff effectively remove snow from our roads and streets by keeping the pavements free of parked cars. This extra room provides the space needed by the plow trucks to maneuver and push snow off the streets.
- Parking is prohibited on any village street during, or after a snowfall in which there is an accumulation of two (2) inches of snow or more.
- The Police Department will enforce this regulation: violators will be ticketed and may be towed (at the owner's expense).
- On-street parking may resume when the snowfall has stopped and village crews have removed the snow to the curb.
- Residents and business should not plow driveway or parking lot snow onto roadways. Snow pushed onto clean roadways can freeze and become dangerous for both motorists and pedestrians.
SOLICITORS
- Any person wishing to engage in the business of canvassing or soliciting at the residences in the Village must first obtain a permit from the Village Hall. The registrant must give his complete identification, his signature, and the name of his employer and the nature of the products or services that he is representing. The fee per individual is $30.00. The period of expiration is 30 days from the date of issuance. Upon submitting the registration form, the application is forwarded to the Chief of Police to investigate the accuracy of the information and the good character of the applicant. Such investigation will be completed in 10 days.
- Each person must at all times, while engaged in the business of soliciting or canvassing in the Village of Montgomery, carry and display upon his or her person the registration certificate. The hours of solicitation are between 9:00 a.m. and 9:00 p.m. Monday through Saturday. Solicitation is not allowed on Sundays or holidays.
- Charitable, religious or political solicitors or any other non-commercial solicitors are not required to obtain a Solicitor Permit.
- Residents and other persons within the village shall be entitled to post a "No Solicitors", "No Solicitation", or other similar sign on the property which they own or occupy, where it is reasonably visible to individuals who may approach the house, apartment, building or other edifice near or on which the sign is posted, in order to notify any such individual that no solicitation, canvassing or peddling of any type is desired by the occupant without the occupant's prior approval.
- It shall be unlawful for any person, whether engaging in commercial or noncommercial canvassing, solicitation or other similar enterprise, to, when entering upon a premises which has a reasonably visible "No Solicitors" or other such similar sign, continue with the attempted canvassing or solicitation. Upon sight of such sign, the canvasser or solicitor must leave the premises. If such sign is reasonably visible, the canvasser or solicitor shall be presumed to have seen the sign and shall be in violation if he or she attempts his or her canvassing or solicitation.
STREETS
- The Village of Montgomery Public Works staff is responsible for maintaining all infrastructure improvements within the Village, including streets, water collection and distribution pipes, storm and sanitary sewer lines, drinking water wells and pumping equipment, village-owned property and buildings, street lighting, traffic signals and signs, and water treatment facilities. In addition, Public Works provides ongoing public services such as brush pick-up and disposal, leaf pick-up, snow plowing, mosquito control, and right-of-way tree maintenance.

- A permit is required to install a swimming pool.
- A plat of survey, a J.U.L.I.E. dig number and a copy of the filtration plans must be provided at the time of application.
- Please show the location on the plat of survey the following:
- Location of pool.
- Where electric will be trenched from the house/garage to the pool location, grounding, the disconnect, and the pump location. If the pool will be heated, show gas line too.
- Describe the wiring method, depth, raceway, type of wire and size.
- Above ground pools higher than 42 inches do not require a fence, but should have a removable/collapsible ladder.
- If the pool is lower than 42 inches or is an in ground pool; the pool or yard must be fenced in.
- Minimum setbacks from rear and side property line are seven (7) feet.
- The seven feet includes deck, if there is one.
- The pool should be kept out from overhead lines (if there is any).

VACATION PROGRAM
- Residents who will be away from home and would like the Police Department to keep an eye on their house may request Vacation Check Service by filling out the attached Vacation Check Form. This form provides information on the dates the home will be unoccupied, contact information, vehicles that will remain at the house, and lights that will be left on or set on a timer. This information will assist Police in identifying possible suspicious activity at the home. The form may be printed and mailed to the Police Department, or may be filled out online and e-mailed to the Police Department at police@ci.montgomery.il.us.
- It is important that the homeowner notify the Police Department to cancel this service after returning home. Anyone who calls to cancel Vacation Check Service will be asked to provide the code number given on the Vacation Check Form in order to ensure Police that the caller is actually the returning homeowner.

- To be eligible to register a person must:
- Be a U.S. Citizen.
- Be 18 years of age by the next election.
- Reside in the precinct for 30 days prior to the next election.
- Change of Voting Address:
Voters who have changed their address since registering to vote should notify the Village Clerk's office at (630) 896-8080 ext. 1559.
WATER BILLING
- Why is my water bill high?
- You could have a leak. Please call the water billing clerk at (630) 896-1357 before calling a plumber.
- You may have been doing extra watering outside.
- There may be more people residing in the house or using more water for some reason.
- How do I get a rebate/credit for water usage on new sod, seeding or filling of a pool?
The Village of Montgomery does not rebate/credit anyone for these things; please call Fox Metro at (630)892-4378 for a credit on your sewer bill.
WATER CONSERVATION
Water is a limited natural resource that must be used wisely and protected for the future. To accomplish this, the Village Board passed Ordinance #1108 amending the mandatory water conservation regulations in the Village of Montgomery, which applies to all users of Village water from May 1 - September 30 each year. The amendment makes it illegal to water a new lawn (a lawn planted between July 1 and August 31) with water from the Village system.
Restricted Watering
Landscape watering (except New Sod and Seeded Turf Lawns) or the filling of swimming pools is allowed from 6-9 AM and again from 6-9 PM as follows:
- Properties with an even-numbered address may water on even-numbered calendar dates
- Properties with an odd-numbered address may water on odd-numbered calendar dates
These restrictions do not apply to hand-held watering devices; swimming pools holding 50 gallons or less; or vehicle and equipment washing.
Sod Laying and Lawn Seeding
From July 1 through August 31, use of water from the Village system to water and establish New Sod and Seeded Turf Lawns is prohibited. During this period, water from the Village system may be used to water new turf areas less than 100 square feet in area, such as lawn repairs, using the “Restricted Watering” provisions listed above.
At all other times, use of water from the Village system to establish New Sod and Seeded Turf Lawn is allowed with the following provisions:
- On the first day new sod or seed is planted, watering is allowed for up to 8 total hours that day
- For the next 9 days, watering is allowed every day from 6-9 AM and from 6-9 PM
- After the first 10 days, “Restricted Watering” even/odd provisions, as listed above, will apply.
Exceptions
This Ordinance does not apply to commercial and industrial entities where use of water is necessary for normal business operations. These exceptions do not apply to non-essential business uses such as decorative landscape watering.
Prohibited Waste
No person shall allow a continuous stream of water from the Village water supply to run off into any gutter, ditch, drain, or street inlet while using Water for any purpose.
Fines and Penalties
Any person who violates the provisions of this Ordinance will be subject to a fine as follows:
- $50 for each first offense.
- $100 for each second offense.
- $500 for each subsequent offense.
- Up to $500 for New Sod and Seeded Turf Lawn watering violations.
Each day a violation occurs or is permitted to continue will be considered a separate violation. If a fine goes unpaid, the amount may be added to the person's water bill.
WEATHER WARNING
- Means severe weather has been sighted in our area. A warning usually lasts for 45 minutes to an hour.
WEEDS
- All premises and exterior property shall be maintained free from weeds or plant growth in excess of 10 inches. All noxious weeds shall be prohibited. Weeds shall be defined as all grasses, annual plants and vegetation, other than trees or shrubs provided; however, this term shall not include cultivated flowers and gardens.
YARD WASTE
- The Village's refuse hauler also collects yard waste, such as grass clippings, twigs, small hedge trimmings, and plants, on the normal trash pickup days. Place yard waste in either the brown Yard Waste bags available at most grocery or hardware stores or tie sticks and branches into a bundle. Allied Waste will collect one container or bundle of yard waste each week unstickered. Any additional bags or bundles must have a disposal sticker attached. Disposal stickers cost $2.00 and are available at the Village Hall and at local stores.
Yard waste collection will begin:
- On the first garbage pick up day of April.
The last day of yard waste collection will be:
- On the last garbage pick up day of November.

Brush Pick Up
- Brush Pick Up is a service provided to the residents through tax dollars and is carried out by Montgomery's very own Public Works Department. Here are some important reminders:
- What constitutes "Brush"? Brush is considered to be branches, hedge trimmings, etc. that are too large to fit into the brown yard waste bags. Brush must be neatly tied into bundles according to the guidelines below in order to be picked up.
- Brush Pick up is on the same day for everyone - regardless of your regular garbage and recycling collection day.
- Brush pick up begins on Monday of the first full week of the month in April, May, June, July, August, September and October. The only exception is September, when brush pickup begins the day after Labor Day.
- If all brush cannot be picked up on Monday, it will continue to be picked up on Tuesday, Wednesday, etc. It may take several days to complete this service when there is a large volume of brush to be picked up throughout the Village.
- The Village will make every effort to pick up brush on the scheduled dates, however, weather, manpower constraints, mechanical breakdowns, and/or emergencies may prevent pick up on the scheduled day. Simply leave the brush at the curb to be picked up in the next day or two.
Remember: You don't have to wait for the chipper to get rid of your twigs or smaller-sized debris. Place this kind of brush in the brown yard waste bags or tie it into a bundle and leave it curbside for Allied Waste to pick up on your regular garbage collection day!
Important Do's and Don'ts To Ensure Your Brush Will Be Picked Up:
Do: Brush (branches) must be tied with string or twine, in bundles no longer than 4 feet and no larger than 12 inches in diameter. Brush should be stacked in neat, one directional bundles with the larger trunk portion facing the street. Don't: No bundling the brush with wire, please.
Don't: No logs larger than 4 inches in diameter, no bushes with roots and dirt attached or grape vines. The Village recommends that you call a disposal or tree removal service for these items.
Do: Please have your brush set out by 7:00 a.m. on the morning of pick up. If the chipping truck has gone by, they cannot return. Unfortunately time prohibits exceptions to this, so please be sure to place it out the night before or by 7:00 a.m. so you will not be disappointed.
Don't: The Village is not responsible for disposing of brush or logs cut down by contracted work or brush from any non-residential source. Brush pick up is a community service and is not intended to subsidize any resident who chooses to cut down and dispose of large amounts of trees and bushes. Projects of this magnitude require contracting with a tree disposal service. Maintaining this policy is the only way the Village can continue to fairly service all of its residents. Brush from any business property is the sole responsibility of the business owner.
