Request for Public Records
Freedom of Information Act (FOIA) Request
To request public documents, please submit a written request stating the specific record or document you are seeking. For your convenience, a Request for Public Records form is available at the Village Hall or online. Forms mail be mailed to Debra Buchanan, FOIA Officer, 200 N. River Street, Montgomery, IL 60538 or faxed to (630) 896-0791. Requests may also be submitted via email.  The FOIA Officer may be reached by phone at (630) 896-8080 ext. 9003.

The Freedom of Information Act (FOIA) is a state statute (5 ILCS 140) that provides the public the right to access government documents and records. The law provides that a person can ask a public body for a copy of its records on a specific subject and the public body must provide those records, unless there is an exemption in the statute that protects those records from disclosure (for example: records containing information concerning trade secrets or personal privacy).

In compliance with the FOIA statute, the Village of Montgomery will respond to requests for information that are submitted in writing. Request should contain your name, address, the date of the request, a daytime phone number, exactly what it is you are requesting, and how you would like to receive that information. Please make your written request for information as specific as possible in order to expedite the processing of your request.

Requests will be responded to within 5 business days after the public body receives the request. Day 1 of the 5 day timeline is the first business day after the request is received by the public body. If additional time is needed, that time period may be extended for an additional 5 business days from the date of the original due date. If additional time is needed the public body must notify the requestor in writing within 5 business days after the receipt of the initial request along with the statutory reasons for the extension and when the requested information will be produced. 

Documents and records will be furnished in the format in which they are maintained in the Village unless a specific format is requested and it is feasible to furnish the documents or records in the requested format. There will be no fee for the first 50 printed pages; thereafter the Village will charge 15 cents per page. Any cost for reproducing oversized documents that would have to be sent out for reproduction, certain electronic media or color copies, if available, will be passed on to the person(s) requesting the information. Copying costs must be paid before the documents or records are furnished. Please direct all requests, questions or concerns to the FOIA officer(s) listed above.
